Junts per Catalunya decided yesterday to maintain the pulse of the Government and will try to invest Carles Puigdemont telematically, through the reform of the law of the Presidency that was approved last Friday in the Parliament. The formation met in Berlin, where the expresident is waiting for the German justice to decide on his extradition. The spokesman of the parliamentary group Eduard Pujol accepted however that this plan will be truncated by the resource already prepared by the Executive and put as a deadline to invest Puigdemont on May 14. On the 22nd the Catalan Chamber will be dissolved if there is no Govern.
Pujol framed the option of insisting on the investiture of Puigdemont within the will to "be faithful to the outcome of the 21-D elections". "The Spanish justice system has favored actions that have not allowed us to invest or settle positively four investiture since January 30," added the spokesman of the 28 deputies who moved to the German capital to meet the expresident and decide the strategy to continue in the coming days.
Pujol insisted that his formation does not want other elections: "Before May 22 we must have resolved the political situation," he said. However, the commitment to hold on to invest Puigdemont telematically will have an ephemeral life. Last Friday, the Council of Ministers approved to initiate the procedures to appeal the modification that includes the telematic investiture before the Constitutional Court. The Government is waiting for the Council of State to meet, which must issue a non-binding opinion on the appeal. Subsequently, the sole acceptance of the text by the Altro Tribunal would imply its precautionary suspension. The Constitutional also meets next Tuesday.
The Government also has the possibility of torpedoing Puigdemont's plans through its control of the Official Gazette of the Generalitat (DOGC). The reform of the Presidency law has to be published there so that it becomes effective and, under Article 155 of the Constitution, the Government controls the DOGC.
The possibility of a telematic investiture received the support of the 70 deputies independentistas and the vote against all the opposition. The Council of Statutory Guarantees, an advisory body of the Generalitat, considered the reform illegal. From ERC and PDeCAT - now cast within Junts per Catalunya - accepted to approve it as a way to expose the Government but it was not among the plans to use it.
The bet of Junts per Catalunya passes the pressure on Esquerra, which does not It is for any type of action that involves legal problems for its members. The decision to fix the date of a full investiture rests with the president of the Parliament, the Republican Roger Torrent. ERC expects the government to block this route before having to face a second time to say no to Puigdemont.
Last January, Torrent postponed the plenary session in which Puigdemont had to be invested in theory after the Constitutional Court I forbade it. The spokesman, however, did not close the door to finally choose a candidate without judicial charges. "We would have to value the investiture of Jordi Sànchez, which we have defended twice. If this possibility can not be realized either, we would have to open the door to a new alternative, "said Pujol.
All in all, Junts per Catalunya is looking to gain time and aims at the new road. put the ball on the roof of the Spanish Government. If the High Court decides to apply precautionary measures and suspends the votes and the CUP insists on abstaining, the independence movement would lose the majority to invest in the second round.
After the meeting, Pujol explained that, when they govern, a special commissioner will be created. to overcome the 155 ". This figure will be, he said, "a door that listens to all those people who have had problems" by the application of the article.
The former president was arrested in northern Germany on March 25 when I was coming back from a conference in Finland. Since then he is in Germany waiting for the higher court of Land of Schleswig-Holstein to take a final decision on his possible extradition. Spain has filed a euroorder claiming the delivery of the former president for high treason and embezzlement of public funds.
The next step, however, corresponds to the Schleswig-Holstein Prosecutor's Office, which must now present its proposal on the delivery of Puigdemont after having received additional documentation from the Spanish authorities. Wiebke Hoffelner, the judge of the Schleswig-Holstein prosecutor's office who acts as spokesperson in this case, explained to this newspaper that the proposal of the regional prosecutor's office "will still take a few days" and that in any case, the process is within the deadline set by German law.
The processing of the delivery process under the euroorder by Spain should not be extended in principle more than 60 days after the arrest of Puigdemont on 25 March. The deadline of the German justice almost overlaps with the deadline to achieve the investiture in the Catalan Parliament.
